This Privacy Policy describes the information Danone North America Public Benefit Corporation (“Danone North America”, “we”, “our”, or “us”) collects, how we use this information, with whom we share it, and the choices you have in connection with this.
Applicability
This Privacy Policy applies to any and all websites or other digital products made available by Danone North America (the “Websites”). All Websites governed by this Privacy Policy will include a link to and/or a copy of this Privacy Policy on the home page.
Information collection and use
A. Information Collected From You
Danone North America will collect personal information from you when you:
- Complete coverage or reimbursement forms: If you are seeking coverage assistance or reimbursement for a medical product, we will collect your personal identifiers (name, physical address, telephone number, email address, and signature) and your medical information (health insurance information and diagnosis). If you are a healthcare professional, we will collect your personal identifiers (name, physical address, telephone number, email address, Tax Identification Number, National Provider Identifier (NPI), and signature). We use this personal information to assist you with your coverage and reimbursement for Danone North America products and to communicate with you.
- Contact us: When you contact us, we collect your personal identifiers (name and email address) and any other information you choose to include in your correspondence. We use this personal information to respond to your questions or inquiries, troubleshoot where necessary, and address any issues you may have.
- Create an account: When you create an account, we will collect your personal identifiers (name, date of birth, email address, zip code, and selected password). We use this personal information to create and maintain your account and to communicate with you.
- Make a payment: If you make a payment, we will collect from you, with the assistance of a third party, your personal identifiers (name, physical address, telephone number, and email address), your commercial information (invoice number), and your payment information (payment card number, Card Verification Value (CVV), and expiration date). We use this personal information to process your payment. Please note our payment processor collects and processes this personal information on our behalf and Danone North America only retains historical payment information.
- Make a purchase: If you purchase our products online, we will collect your personal identifiers (name, physical address, telephone number, and email address) and your payment information (payment card number, CVV, and expiration date). We use this personal information to process your payment and to fulfill and manage your purchase.
- Participate in a sweepstakes: If you participate in a Danone North America sweepstakes, we will collect your personal identifiers (name, mailing address). We use this personal information to administer the sweepstakes and to communicate with you about the sweepstakes. For information on our information practices with respect to a particular sweepstakes, please refer to the official rules of the sweepstakes.
- Participate in an online community: To participate in certain online communities, you will need to create an account. To do so, we will collect your personal identifiers (name, email address, selected username and password). We use this personal information to create your account, facilitate access to the online community, communicate with you, provide you with relevant content and advertising, and monitor and operate the online community. As you use the online community, we will collect any other information you choose to disclose. Please keep in mind that any information you post is available to be viewed by the public. You should exercise caution in determining what information you post. Danone North America cannot prevent further disclosure of information from your posts and is not responsible in any way for such use of the information. You should carefully review the Terms of Use of any online community you participate in as they may contain additional important information.
- Request a coupon referral pad (healthcare professionals): When you request a coupon referral pad, we will collect your personal identifiers (name, physical address, state license number, telephone number, and email address). We use this personal information to assess your request and to communicate with you.
- Request a sample (healthcare professionals): If you request a product sample, we will collect your personal identifiers (name, email address, physical address, and telephone number). If you request a sample on behalf of your patient, we will collect the patient’s personal identifiers (name, email address, date of birth, telephone number, and physical address) and the patient’s medical information (condition). We use this personal information to communicate with you and to fulfill and manage your sample request.
- Submit a bulk or wholesale inquiry: When you submit an inquiry, we will collect your personal identifiers (name, email address, telephone number, and physical address) and any other information you choose to include in your correspondence. We use this personal information to respond to your inquiry and communicate with you.
- Subscribe for coupons and updates: If you elect to receive Danone North America coupons or updates, we will collect your personal identifiers (email address, date of birth, and zip code). We use this personal information to fulfill your request to receive coupons and information on Danone North America we feel may be of interest to you.
Danone North America may also use your personal information collected for the above purposes to comply with the law and for other limited circumstances as described in INFORMATION SHARING.
B. Information Collected Automatically
In addition to the personal information you provide directly, Danone North America may also collect information from you automatically as you use our Websites via cookies. This includes the following internet or other electronic network activity information:

- Device information: We use essential, performance, analytics, and advertising cookies to collect certain information about the device you use to access our Websites, such as browser type, browser language, hardware model, operating system, and your preferences. We use this personal information to: (i) conduct analytics; (ii) enhance user experience; (iii) provide you with interest-based online advertising and measure the effectiveness of our advertising; (iv) prevent fraudulent use of the Websites; and (v) diagnose and repair errors.
- Location information: We use essential, performance, analytics, and advertising cookies to collect information about your location, which may be determined through your IP address. We use this personal information to: (i) conduct analytics; (ii) enhance user experience; (iii) provide you with interest-based online advertising and measure the effectiveness of our advertising; (iv) prevent fraudulent use of the Websites; and (v) diagnose and repair errors.
In general, to disable cookies and limit the collection and use of information through them, you can set your browser to refuse cookies or indicate when a cookie is being sent. To opt-out of interest based advertising generally or to learn more about the use of this information, you can visit the Network Advertising Initiative or the Digital Advertising Alliance. Particular third-party cookies to note on our Websites include the below. Please note the use of these cookies may be considered a “sale” under the California Consumer Privacy Act.
- DoubleClick: We utilize DoubleClick by Google to serve ads based on a user’s prior visit to Websites. Each visitor receives a different cookie and the information collected by the cookie is used to generate conversion statistics and allows us to see the total number of individuals who clicked on our ads. DoubleClick enables Google and its partners to serve ads to you based on your visit to our Websites in addition to other websites on the Internet. Please review Google’s Privacy Notice for additional information on how Google uses the information collected. To opt-out of targeted advertising by Google and this sharing, you can go to Google’s ad settings or you can install the DoubleClick opt-out add-on
- Facebook Pixel: We use Facebook Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior to be tracked after you have been redirected to one of our Websites by clicking on the Facebook ad. The Facebook Pixel stores a cookie on your device to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes. We do not have access to the information collected through the Facebook Pixel. However, the information collected via the Facebook Pixel is also stored and processed by Facebook. Facebook may link this information to your Facebook account and also use it for its own promotional purposes in accordance with Facebook’s Data Usage Policy. The Facebook Pixel also allows Facebook and its partners to show you advertisements on and outside of Facebook. You can opt-out of displaying Facebook ads and sharing by visiting your Facebook Ad Settings, and you can clear and control the information third parties share with Facebook in your Off-Facebook Activity page. If you do not have a Facebook account, you can opt-out of Facebook ads through the Digital Advertising Alliance.
- Google Analytics: To conduct analytics, we use Google Analytics. Google Analytics may set cookies on your browser, or read cookies that are already there. Google Analytics may also receive information about you from applications you have downloaded that partner with Google. The Google Analytics Terms of Use and Privacy Policy describe how Google may use and share the information collected by Google Analytics. To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on.
Information collection and use
Danone North America may share the personal information identified in this Privacy Policy in the following instances:
- Within Danone North America: Where necessary, we share your personal information within Danone North America, our affiliates, and subsidiaries in order to efficiently carry out our business and to the extent permitted by law.
- In the event of a corporate reorganization: In the event that we enter into, or intend to enter into, a transaction that alters the structure of our organization, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our assets, we would share your personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We would also share your personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.
- For legal purposes: We will share your personal information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of use or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.
- For a business purpose: In the preceding 12 months, we have shared your
- personal identifiers and internet and other electronic network activity information with service providers that perform services on our behalf in connection with the Websites. These service providers include our IT support, communications vendor, payment processor, legal and risk, data analytics providers, and carrier services.

Rights of California, Colorado & Texas residents
The California Consumer Privacy Act (CCPA), Colorado Privacy Act (CPA), and Texas Data Privacy and Security Act (TDPSA) grant certain rights to their respective State residents. If our processing of your personal information is subject to the CCPA or CPA, you are entitled to the following rights:
- Right to access: You have the right to request what personal information we have collected, used, disclosed, and sold about you within the preceding twelve months. You may only make a request for access twice within a twelve-month period.
- Right to a copy: You have the right to request a copy of your personal information in a portable and readily useable format.

- Right to restrict uses of sensitive personal information: You have the right to request that we limit our use of your sensitive personal information to that use which is necessary. Sensitive Personal Information includes a person’s social security number, driver’s license, state identification card, passport number, a log-in, financial account, debit card or credit card numbers, security or access code, password, credentials allowing access to an account, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, consumer’s mail, email, text messages (unless the business is the intended recipient), genetic data, biometric information, health information, or information about a person’s sex life or sexual orientation.

For requests submitted via telephone and email, you must provide us with sufficient information that allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. Our interactive webform contains all information we require to process your request. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a request related to your personal information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual.
Rights of Nevada residents
If you are a consumer in the State of Nevada, you may request to opt-out of the current or future sale of your personal information. We do not currently sell any of your personal information under Nevada law. Marketing emails
You may opt-out of receiving marketing emails from us by clicking the “choice/opt-out” link provided with each email. Please note that we will continue to send you emails necessary to the Websites or any assistance you request.
Do not track
We do not support Do Not Track (DNT). Do Not Track is a web browser setting that informs websites that you do not want to be tracked.
Information security
We implement and maintain reasonable security measures to protect the personal information we collect and maintain. These security measures include, but are not limited to, access controls and encryption. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the information we have collected from you.
Age restriction
Danone North America does not knowingly collect personal information from visitors under the age of 13, except as otherwise set forth below. Most of the Websites are general audience websites or digital properties directed towards general audiences. For those Websites that may be directed at children under 13, we do not knowingly collect personal information without parental consent. If parental consent is not obtained within a reasonable time, any parental contact information collected by Danone North America for such verification purposes will be deleted. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information. If you are a parent concerned that your child may have provided personal information to us, please contact us in the manner described in the Contact Us section below.
From time to time, Danone North America may knowingly collect personal identifiers (name, email address, postal address, and a parent or guardian’s email address) from children. We may use this information for purposes such as the facilitation of children’s promotion, sweepstakes and/or contest. To assist us with the purpose(s) set forth above, we may share this personal information with third parties who are bound by restrictions of use and confidentiality obligations. These third parties may only use this information as mandated by Danone North America, and may not make any independent use of this information. Danone North America and the third parties described herein will use this information only as long as is reasonably necessary to fulfill the purposes for which the information was collected, and upon such fulfillment of purpose, will delete the information using reasonable measures to protect against unauthorized access to, or use of, the information in connection with its deletion.
As a parent or guardian of a child, you may request to review, and modify or have deleted, any personal information we have collected from your child, and refuse to permit further collection or use by us of your child’s information. You may make such requests by contacting us in any of the ways listed below in the Contact Us section.
Changes to this Privacy Policy
We may change this Privacy Policy from time to time. We will post the changes to this page and will indicate the date the changes go into effect. We encourage you to review our Privacy Policy to stay informed.
